Other than as otherwise agreed in writing by the parties concerned, orders placed on-line or by any other means are subject by right to the general terms of sale hereby mentioned.

1. Terms of payment
Payments by credit card are 100% secured by SP PLUS, the Caisse d’Epargne’s on-line payment service. Concerning on-line payments by credit card, we will never be aware of your personal banking information which is and will remain confidential. Payments which are not made on-line but by transfers, checks, giro checks or credit cards are accepted. Invoices are made for cash payments, net without any discount.
2. Prices
The prices indicated are all taxes included, shipping charges to be added (except for Primeurs, indicated before charges). Prices include the current value-added tax, excises and other applicable taxes.
The company reserves the right to modify prices at any time, but the products ordered are billed on the current prices at the time the order is confirmed.
Prices and offers communicated on the website are only applicable to private customers and under no circumstances to professional retailers. The company reseves the right to deny access to the benefits of its offers to any non-eligible customer.
3. Shipping charges
Shipping charges are subject to a lump sum which varies in regard to the country of destination. Details of all the shipping charges can be checked any time on the company website at the following address: http://www.rouge-blanc.com/Tarifs&conditions

If the customer makes an error in the delivery address he or she gives to the company, obliging the company to ship the orders back to its warehouse, this customer will bear the consequences. Moreover, the company will be within its own right to bill administrative and transportation costs occurred by returned orders, ie. 20 euros per parcel for France and 50 euros per parcel for any other country.
If the reception of the settlement is late, the company will not be held liable for any delivery delays.
4. Risk and title
Products remain the company’s propriety until the total settlement of the order is completed, in accordance with the law n° 80 335 enforced on May 12, 1980, concerning the retention of title. Products are shipped to their addressee only after total settlement of the order.
5. Availability of goods
Products are on sale if they are in stock. If the company runs out of stock, it will replace the product ordered by another product from the same region and of the same or another year but of a value at least equal or superior to the unavailable bottle. Nonetheless, the company asks for the customer’s agreement first, who by this agreement will renounce to his or her right to claim damages.
6. Deliveries and liabilities
Deliveries are made by carrier or by La Poste (French national mail service company). The company fixes a potential delivery date when the order is confirmed. Potential delays do not give the customer the right to cancel the purchase or to claim damages. The customer is notified of the day of delivery by email or phone call.
If the customer is absent on the day of the delivery, the carrier will leave a delivery note. The customer will then agree a new delivery date with the carrier. The customer can not cancel the purchase on the motive of non-delivery if he or she was absent on the day of the delivery. In this case, the customer can not claim damages or renounce the purchase. The address of delivery is the one specified on the order form the customer confirmed. The company can not be held liable for any mistake if the delivery address is wrong. In this case, any return to the company warehouse can generate charges that can be billed to the grantor, in accordance with Article 3 of the general terms of sale.
Goods always travel at the addressee’s own risks. Always check your parcel when it is delivered to you, in the presence of the carrier, to testify that there is no breaking of the bottle and that the order is in conformity with the delivery slip. Once this certificate is signed, the customer will not be able to make a complaint if there is any bottle breaking or if the product does not correspond to the order previously placed. The customer has 48 hours to make a potential complaint to the carrier or to the company in case of breach of duty or deterioration. Within 14 days following the delivery of his or her parcel, each addressee can send back, at his or her own cost, the goods in their original packaging to the address indicated on the delivery slip.
The repayment will be made to the grantor once the company warehouse receives the goods, after deduction of the shipping charges, of the filing charges for a fixed amount of 10 euros (all taxes included) and of potential damaged products.
For some reasons of logistics costs and to make sure the delivery will be made in the best conditions, the company can split the order in several parcels. In this case, the addressee will receive its order in several parcels, but the company can not assure that all the parcels will be delivered at one time. In case of force majeure, the company can cancel the delivery.
7. Low prices 100% warranted: we pay back the difference!
Low prices 100% warranted : we pay you back the difference if you find the same product cheaper elsewhere ! After having bought a product on the company website and within 24 hours after you placed your order, if you find a similar offer, in stock and available, with the same delivery time and conditions, but for a cheaper price (shipping charges not included) on another French website, the company will pay back the difference in price.

Conditions of application :
Price of the product means the public price offered for each product on the website, excluding all specific promotional offers (discount code, gift-vouchers or others). The repayment of the difference in price is subject to all the following conditions :
- Identical product : new product, same producer / wine grower, same year..
- Similar service conditions : duration of the warranty...
- The delivery time should not exceed the delivery time offered by the company by 5 days.

Exclusions :
This offer does not apply on :
- Destocking products.
- Products sold on auction websites or on announcement websites.
- Deliveries outside Metropolitan France.

Mode of repayment :
If all the above conditions are fulfilled and after expiration of your retraction period, the company will pay you back the difference in price, within 15 to 30 days by cheque.

Proofs :
Order confirmations are archived at the company headquarters and are considered to be the proof in nature of the agreement and of its date.
8. Warranties
According to Article 1641 of the Civil Code : the warranty applies to products with latent defects which make the product unsuitable to its original use, or which diminish such a use to the point that the customer would never have bought (or would have bought for a cheaper price) the product if he or she was aware of it,
Consequently, the customer can send his or her complaint to the company within two months after the date of delivery. After this time, the company will not warranty the wine bottles, or the customer will have to prove that the adulteration was prior to the sale.
In order to allow the company to proceed to the valuation by its own means, we ask the purchaser to leave the bottle(s) to our disposal. The company will pick it / them up at its own cost.

Exclusion :
Wine from the Fine Wine cellar, rare and / or old wine do not enter into the warranty. These bottles of wine are offered for sale only on the criteria of fame without having been tasted by the company tasting committee.
The company undertakes to cancel the order on the customer’s request and to proceed to its total repayment in case of non respect of the delivery time or in respect to the warranty low prices 100% warranted (except in case of force majeure of the company or its carrier) in respect to Article 6 of the general terms of sale.
9. Data Protection and Freedoms
In pursuance to Article 27 of the law n° 78-17 enforced on January 6, 1978, concerning data processing, you can use your right of access and rectification regarding your personal information, by sending a mail or an email to the customer service. The general customer file of the company is registered to the French National Data Protection Agency (Commission Nationale de l’Informatique et des Libertés CNIL).
All these data permit us to offer you personalized services such as the specific offers sent to you by email or mail. If you do not want to receive these offers, just inform us by email or mail.
10. Competent court
The present general terms of sale are subject to French law. By express agreement, the Trade Court of Versailles is competent to decide on any claim regarding the placement or the filling of the order, or in case of litigation, unless our company chooses to bring the matter before another competent court. Anyway, in case of litigation and in regard to the present contractual relationship, both parties pledge to try to settle the matter out of court.
11. Protection of minors
In pursuance to Article L. 3342-1 of the Public Health Code which stipulates that the sale of alcohol to minors under 16 years old is forbidden, the buyer, by filling out the order notice, testifies to be older than 16 years old the day the order is placed.
